North Georgia Technical College (“Grantee”) receives grant funds from the National Science Foundation (“NSF”). Pursuant to Proposal & Award Policies & Procedures Guide (PAPPG) (NSF 22-1), Grantee publishes the following notice:
Grantee complies with Title VI of the Civil Rights Act of 1964 (42 USC § 2000d) (prohibits discrimination on the basis of race, color, or national origin), Title IX of the Educational Amendments of 1972 (20 USC §§ 1681 et seq.) (prohibits discrimination on the basis of sex in Federally assisted education programs or activities), Section 504 of the Rehabilitation Act of 1973 (29 USC § 794) (prohibits discrimination on the basis of disability); the Age Discrimination Act of 1975 (42 USC §§ 6101 et seq.) (prohibits discrimination on the basis of age), and all regulations and policies issued by NSF pursuant to these statutes.
In addition to statutory prohibitions, Executive Order (E.O.) 11246 bars various types of discriminatory employment practices under grants for construction, and E.O. 13166 “Improving Access to Services for Persons with Limited English Proficiency (LEP)” requires government agencies to take steps to provide meaningful access to its programs and activities to members of the public who are limited in their English proficiency, including recipients’ programs and activities.
As the primary funding agency of fundamental science and engineering research in the U.S., NSF is committed to promoting safe, productive research and education environments for current and future scientists and engineers. NSF considers the PI and any co-PIs identified on an NSF award to be in positions of trust. The PI and co-PI(s) and all award personnel must comport themselves in a responsible and accountable manner during the performance of award activities whether at Grantee Institution, on-line, or conducted outside the Institution, such as at field sites, or facilities, or during conferences and workshops.
In support of this position, NSF requires that Grantee notifies it: 1) of any findings/determinations regarding the PI or co-PIs that demonstrate a violation of awardee codes of conduct, policies, regulations or statutes relating to sexual harassment, other forms of harassment, or sexual assault; or 2) if Grantee places the PI, or co-PIs on administrative leave or imposes an administrative action relating to a finding or investigation of a violation of awardee policies, codes of conduct, statutes or regulations relating to sexual harassment, other forms of harassment, or sexual assault.
NSF expects all research organizations to establish and maintain clear and unambiguous standards of behavior to ensure harassment-free workplaces wherever science is conducted. A community effort is essential to eliminate sexual and other forms of harassment in science and to build scientific workspaces where people can learn, grow, and thrive.
To that end, in accordance with the above-referenced nondiscrimination statutes and executive orders, and NSF’s implementing regulations and policies, no person in the United States shall, on the ground of race, color, national origin, sex, disability, or age, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for which the Grantee receives Federal financial assistance from NSF.

If you file your complaint with this Recipient, you must wait either until the Recipient issues a written Notice of Final Action, or until 90 days have passed (whichever is sooner), before filing with the Civil Rights Center (see address above).
If the Recipient does not give you a written Notice of Final Action within 90 days of the day on which you filed your complaint, you may file a complaint with CRC before receiving that Notice. However, you must file your CRC complaint within 30 days of the 90-day deadline (in other words, within 120 days after the day on which you filed your complaint with the recipient).
If this Recipient does give you a written Notice of Final Action on your complaint, but you are dissatisfied with the decision or resolution, you may file a complaint with CRC. You must file your CRC complaint within 30 days of the date on which you received the Notice of Final Action.
